Terms & Conditions

These Terms govern your use of Eduvian's products and services. By using them, you accept the conditions described below.

1. Introduction

Welcome to Eduvian.

These Terms and Conditions of Use (the “Terms”) govern access to and use of the websites, applications, platforms, content, products, and services offered by Eduvian (collectively, the “Services”).

By creating an account, accessing, or using the Services, you agree to be legally bound by these Terms. If you do not agree with them, you must refrain from using the Services.

2. Who we are

Eduvian is a technology platform focused on learning and academic preparation through digital tools, including practice systems, assessment, performance analysis, and adaptive learning.

For the purposes of these Terms, references to “Eduvian,” “we,” “us,” “our,” or “the Platform” refer to the entity responsible for providing the Services.

3. Eligibility and minors

The Services are intended for individuals who have the legal capacity to accept these Terms.

Underage users may use the Services only with the authorization and supervision of their parent or legal guardian.

When an account is created for a minor, the responsible adult represents that they:

  • Have the legal authority to act on behalf of the minor.
  • Accept these Terms on behalf of the minor.
  • Authorize the processing of the minor's personal data in accordance with Eduvian's Privacy Policy.
  • Take responsibility for supervising the use of the account.

Eduvian may suspend or cancel accounts when it detects a breach of these provisions.

4. Registration and account security

Some features require the creation of an account.

The user agrees to:

  • Provide truthful, accurate, and up-to-date information.
  • Keep their access credentials confidential.
  • Immediately report any unauthorized access to their account.

The user is responsible for all activity carried out through their account, unless they can demonstrate unauthorized use beyond their reasonable control.

5. Description and availability of the Services

Eduvian offers digital educational tools that may include, among others:

  • Academic preparation platforms.
  • Adaptive practice systems.
  • Diagnostic assessments.
  • Performance analysis.
  • Digital educational resources.

We reserve the right to modify, update, suspend, or discontinue any part of the Services at any time.

Although we strive to maintain continuous availability, we do not guarantee that the Services will be free of interruptions, errors, or technical failures.

6. Plans, payments, and subscriptions

Some Services may require payment of a one-time fee or a recurring subscription.

Before completing a purchase, the following will be clearly disclosed:

  • The applicable price.
  • The billing frequency.
  • The duration of the plan.
  • The renewal conditions.

Payments are processed by specialized third-party providers. Eduvian does not store full credit or debit card details.

Automatic renewal

Unless otherwise stated, subscriptions will renew automatically at the end of each billing period.

The user may cancel automatic renewal at any time from their account or through the available contact channels.

Cancellation will prevent future charges but does not generate refunds for periods already billed, unless applicable law or a specific policy provides otherwise.

7. Money-back guarantee

Certain products or services may include a money-back guarantee.

The specific conditions, including period, requirements, and limitations, will be stated on the relevant sales page and will form an integral part of these Terms.

Where there is a discrepancy between these Terms and the conditions published for a specific guarantee, the particular conditions of the relevant product will prevail.

8. Permitted use of the Services

The user agrees to use the Services only for legitimate, educational purposes and in accordance with applicable law.

The following is prohibited:

  • Accessing systems, networks, or databases without authorization.
  • Interfering with the security or operation of the Services.
  • Performing reverse engineering, decompilation, or attempts to extract the source code.
  • Using bots, scrapers, or automated tools to collect information.
  • Copying, reproducing, redistributing, or commercializing content without express authorization.
  • Using the Services in a fraudulent manner or contrary to the rights of third parties.

9. Intellectual property

All intellectual property rights related to the Services, including software, trademarks, logos, content, designs, databases, and educational materials, belong to Eduvian or its respective licensors.

Use of the Services does not transfer any intellectual property right to the user.

Only a limited, revocable, non-exclusive, personal, and non-transferable license is granted to use the Services in accordance with these Terms.

10. User-generated content

The user retains ownership of the content they upload, publish, or generate within the Platform.

However, by using the Services, the user grants Eduvian a non-exclusive, royalty-free, and limited license to store, process, reproduce, and use such content only to the extent necessary to operate, maintain, improve, and provide the Services.

The user represents that they hold the necessary rights to any content they share on the Platform.

11. Protection of personal data

The processing of personal data is carried out in accordance with Eduvian's Privacy Policy.

By using the Services, the user acknowledges having read that policy and understanding how their personal data is collected, used, stored, and protected.

12. Disclaimers

The Services are provided “as is” and “as available.”

Eduvian makes reasonable efforts to offer quality information and tools; however, it:

  • Does not guarantee specific academic results.
  • Does not guarantee passing exams, tests, or assessments.
  • Does not guarantee that the content is completely free of errors or omissions.
  • Does not guarantee continuous, uninterrupted availability.

Academic decisions made by the user are their sole responsibility.

13. Limitation of liability

To the maximum extent permitted by applicable law, Eduvian shall not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of or inability to use the Services.

Eduvian's total aggregate liability to the user, for any claim related to the Services, shall not exceed the amount actually paid by that user during the twelve (12) months prior to the event giving rise to the claim.

Nothing in these Terms limits liabilities that cannot be legally excluded.

14. Suspension and cancellation of accounts

Eduvian may suspend, restrict, or cancel access to the Services when it reasonably considers that:

  • There is a breach of these Terms.
  • The Platform is being used abusively or fraudulently.
  • There are security risks to other users or to Eduvian's technological infrastructure.

Cancellation of an account does not extinguish outstanding obligations that arose previously.

15. Force majeure

Eduvian shall not be liable for delays, interruptions, or failures caused by circumstances beyond its reasonable control, including telecommunications failures, natural disasters, labor disputes, governmental acts, cyberattacks, or interruptions by third-party providers.

16. Modifications to the Terms

We may modify these Terms at any time.

Modifications will be published on this page along with the corresponding update date.

When the changes are substantial, we may notify users by email, notices within the Platform, or other reasonable means.

Continued use of the Services after the changes take effect will constitute acceptance of the modified Terms.

17. Severability

If any provision of these Terms is declared invalid, illegal, or unenforceable by a competent authority, that provision will be interpreted to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.

18. Governing law and jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Costa Rica.

Any dispute related to the Services shall be submitted to the exclusive jurisdiction of the competent courts of San José, Costa Rica, unless applicable law provides otherwise.
